Digital Millennium Copyright Act (DMCA)

This policy describes how copyright owners or their agents may notify Filedepot of claimed infringement. It is provided for informational purposes and does not constitute legal advice.

1. Designated agent

DMCA notices should be sent to our designated copyright agent at [email protected]. Subject lines that include “DMCA notice” help us route your message quickly.

2. Contents of a valid notice

To be actionable, a notification should include the following, as applicable under U.S. law and our operational requirements:

  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered.
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate that material (for example, the specific URL or file identifier).
  • Your contact information, including name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • A physical or electronic signature of the person authorized to act.

3. Our response

When we receive a complete and valid notice, we may remove or disable access to the material and may notify the user who posted it, consistent with applicable law and our Terms of Service. We may document notices and actions taken.

4. Counter-notification

If you believe material was removed in error, you may submit a counter-notification that meets the requirements of the DMCA, including your contact information and a statement under penalty of perjury. Send counter-notices to [email protected] with “DMCA counter-notification” in the subject line. We may forward your counter-notification to the party who filed the original notice.

5. Repeat infringers

We may terminate or restrict accounts of users who are repeat infringers or who otherwise violate our Terms of Service, where appropriate.
